As announced back in April of 2015, The Independent Cosmetic Manufacturers and Distributors (ICMAD) decided after careful review and consideration, that it could not support the "Personal Care Products Safety Act," Bill (S. 1014) introduced by Sen. Dianne Feinstein (D-CA) and co-sponsored by Sen. Susan Collins (R-ME), as it placed too large a burden on small business, did not provide reasonable national uniformity, and would, if passed, stifle innovation in the cosmetics and personal care industry.

As stated by ICMAD's CEO Pam Busiek in April of 2015, "ICMAD has a long track record of working with federal regulators to promote product safety, honor the best science in our industry, and advance small businesses that innovate and provide jobs. While we admired Senator Feinstein's sincere efforts toward modernization of the FDA laws governing cosmetics, the approach taken in this legislation was in conflict with these goals."

ICMAD strongly supports the "Safe Cosmetic Modernization Act," Bill (H.R. 4075) introduced by Congressman Pete Sessions, which proposes to modernize and significantly enhance the FDA's oversight of cosmetics and cosmetic safety. The Sessions Bill also provides much needed National Uniformity consistent with the recently passed, "Safe and Accurate Food Labeling Act," Bill (H.R. 1599) and the, "Microbead-Free Waters Act of 2015," (H.R. 1321). The Sessions Bill is more aligned with ICMAD's desire to modernize the FDA laws governing cosmetics and ICMAD's long track record of recognizing the importance of product safety and the need to support small business that innovates and provides job formation.

ICMAD will continue to work with its sister organizations to develop a unified and consistent approach to modernization of the FDA laws governing the oversight of cosmetics, for the benefit of our valued Consumers and other cosmetic stakeholders.

As an organization of small business entrepreneurs, ICMAD will continue to collaborate with sister organizations - the Personal Care Products Council and the Professional Beauty Association - and the FDA to modernize its laws and ensure that consumers get safe, high-quality, innovative products that help them look and feel their personal best. As ICMAD has done for the last 40 years, the organization will continue to support small businesses as the creators of innovation and jobs. ICMAD wishes to ensure these businesses remain viable.
